In DC Insurrection Case Degrave Still Detained As DOJ Talks Trump But Judge Asks of GPS

FEDERAL COURT, April 26 – The January 6 Capitol entry by Nathan Degrave, in body armor and a helmet he took off to beat his chest, gave rise to a twice interrupted detention proceeding on February 1 in Nevada. He was detained. Complaint here. Inner City Press live tweeted it here and below.

  Nearly two months later, detained Degrave has arrived in the DC jail and had another detention hearing, before District for the District of Columbia Judge Paul L. Friedman. The body armor, so called, was recharacterized as a motorcycle jacket. Judge Friedman did not rule, saying he wanted to watch the video (which the US is trying to seal). Inner City Press again live tweeted it, here and below.

 Now on April 26, DeGraves ongoing detention was again considered by Judge Friedman, Inner City Press live tweeted it here:

AUSA says DeGrave should be detained, can be distinguished from Munchel, released after DC Circuit decision. AUSA says he incited theft of government property.

Judge Friedman: I don't think we're going to resolve this today. There are 9th Circuit decisions saying that Section 111 contains 3 separate offenses. Do they give defendant adequate notice? We went through this on drug cases.

Now DeGrave's lawyer is saying that he was not correctly Mirandized when he said he was in the Capitol. Officer said, I have to go through the protocol of reading your rights, like in the movies.

DeGrave's lawyer: My client did not delete his Facebook post(s)... He didn't bring any weapon to the Capitol. Not mace. No bear spray.  Judge Friedman: He brought weapons to DC? DeGrave's lawyer: No, I disagree.

 DeGrave's lawyer: OK, he was in a car in which bear spray exploded. Maybe it was in Virginia. Maybe Kentucky. Judge Friedman: But [the case] Munchel speaks of planning. DeGrave's lawyer: Planning has to result in action. People can say all kinds of things.

AUSA: They were supposed to stay at an AirBnB in DC, but it was deemed unsuitable. So they found a hotel in Maryland and showed each other their guns.

Defense: They are bringing up Facebook pages at the last minute.

AUSA: It's cited in my brief.

 Judge Friedman: What's the risk of future obstruction of justice?

AUSA: He hasn't changed his political ideology. He has posted online that Donald Trump is his idol. He's still talking about a rigged election. This threat is not purely in our past.

Talk turns to GPS monitoring.

Judge Friedman says, I am not deciding this today, just want to know if case I later release him.
