FEDERAL COURT,
Feb 17 – Detained
after
the US Capitol
incursion on
January 6,
Eric Gavelek
Munchel and
Lisa
Eisenhart
appeared on
February 17
before before
DDC Judge
Royce C.
Lamberth. In
the air:
the zip-ties
Munchel
was photographed
with. Then
after
the argument,
the hammer
dropped: detention for
both, Order
here.
Inner
City Press
live tweeted
it here:
Assistant
US Attorney
Ahmed Baset:
The video
shows Mr.
Munchel is
helping people
to approach
and come
closer to the
Capitol. In
terms of
conditions of
release, the
single chat
found on his
cell phone
show no
condition
could preclude
him from
coordinating
with Proud
Boys
AUSA:
His priority
is to be, as
he'd put it, a
true patriot.
So no
conditions
could prevent
danger to the
community. The
transition of
power to
President
Biden has made
this worse:
Ms. Eisenart
says she is
willing to die
for this cause
AUSA:
The argument
that they did
not try to
hide should
not be
credited -
they knew the
whole world
was looking
for them, the
FBI, everyone.
Still, Mr.
Munchel
deleted his
Facebook
account so the
media would
stop
bombarding
him.
AUSA:
The release
conditions
would have Mr
Munchel
staying at the
house of W-2.
We've obtained
a video from
his phone
that's a clip
of a longer
video
AUSA:
Ms. Eisenart
and Mr.
Munchel, they
felt entitled
to walk into
the Capitol
building; they
were willing
to use force
to stop the
vote from
being
certified.
They were
dressed for
combat. These
conditions
still exist in
our country.
Do not release
them.
Eisenart's
lawyer Gregory
Smith: My
client only
heard "someone
punched two of
them." She
didn't know
they were
police
officers.
Dying for
cause? That's
false. She
said, She
would rather
die than live
under a
country of
oppression.
There is no
cause she's
connected with
Eisenart's
lawyer: In
terms of
feeling
entitled, if
it were ever
true, it's not
now. In prison
the
temperature is
55 degrees. 23
hours in the
cell. She was
prohibited
from any phone
calls, even on
her mother's
birthday this
last Sunday
Eisenart's
lawyer: It
would be wrong
for the Court
to conclude
they would not
comply with
conditions.
She's been a
registered
nurse for 30
years.
Munchel's
lawyer Sandra
Roland: The
AUSA's
rebuttal was
like a
sentencing
argument.
Judge
Lamberth: I'll
rule as
promptly as I
can. For the
next
conference,
March 10 at 1
pm.
Eisenart
will not
consent to
Speedy Trial
time
exclusion. But
there's a DDC
order, no?
Shortly after,
both were
ordered detained:
"Given
Munchel's
brazen actions
in front of
hundreds of
law
enforcement
officers and
manifest
disrespect for
the rule_ of
law, the Court
is not
satisfied that
Munchel would
comply with
any release
conditions.
Munchel has
indicated that
he would be
willing to act
against
Congress
again, and
nothing short
of pretrial
detention can
prevent him
from doing so....
s, Eisenhart
indicated that
she was
willing to
undertake such
actions
aga111. Her
words were
chilling: This
country was
founded on
revolution. If
they're going
to take every
legitimate
means from us,
and we can't
even express
ourselves on
the internet,
we won't even
be able to
speak freely,
what is
America for?
I'd rather die
as a
57-year-old
woman than
live under
oppression.
I'd rather die
and would
rather fight."
Order here.
We'll
have more on
this.
