Friedman.

could impose
conditions of
release in the
Eastern
District of
Pennsylvania
Sanford's
lawyer: He has
a history of
working with
law
enforcement.

is disturbing

Friedman is
going to rule
orally, says
If you are
going to
appeal to the
Court of
Appeals you'll
have to get a
transcript. I
don't know how
the Chief
Judge has time
for written
decisions on
this, she has
so much to do.
There are
videos. First

Friedman:
There is no
presumption
here, under
the Bail
Reform Act.
But there is a
strong
argument for
detention
here. The
question is,
is it be clear
and convincing
evidence.
There is a
crime of
violence
charged, and
the use of a
weapon: a fire
extinguisher
Judge
Friedman
pauses, then
says, Sorry to
be
disorganized,
it's always
that way when
you try to do
an oral
decision
rather than a
written one.
His history
until Jan 6
tilt in favor
of release. No
criminal
history. He
was a fire
fighter for
decades. Now
Judge Friedman
cites, and
will soon
apply, the
factors set
out by Chief
Judge Howell
in US v
Chrestman
(reported on here).
Judge
Friedman: I
find that his
conduct is not
nearly as
egregious as
the others
detained in
our Court. So
I cannot find
by clear and
convincing
evidence that
there are no
conditions for
release.
That's where I
come out.
Judge
Friedman: I
order that he
be released,
not return to
DC, his wife
as 3rd party
custodian.
It's sounding
like he won't
be released
until
tomorrow. Or
Thursday.
Doesn't sound
like US
Attorney's
Office is
going to
appeal.
We'll
