US v. Ethan Nordean, before DDC Chief
Judge Beryl A. Howell. One wild card: the DDC
Grand Jury indicted him around noon today.
Nordean also goes by Rufio Panman.
Chief Judge Howell: Defendant [Nordean /
Panman] was arrested in the Western District
of Washington. No Preliminary Hearing was held
by Feb 17, the 14th day. But the fact that the
defendant has now been indicted obviates the
requirement for a preliminary hearing.
Chief Judge Howell: The Marshals tell me
that due to weather and other circumstances
(pandemic cited), he has not yet been
transported to this district. Next, the
substance of the detention hearing here. Now
that he's indicted, his case will be randomly
assigned
AUSA: I am not arguing the use of the residual
clause here. Chief Judge Howell: The 2d
Circuit has made it clear that the use of the
residual clause here is not Constitutionally
suspect. Is the Government catching up with
that?
Chief Judge Howell: This defendant is linked
to the Proud Boys, but he is not the leader of
the Proud Boys. Other Proud Boys have been
released: Nicholas DeCarlo, Joe Biggs,
Nicholas Ochs...
. AUSA: The government feels there is
ample evidence to hold Mr. Nordean.
AUSA: Members of the Proud Boys acted
intentionally to remove metal barriers, for
example, William Pepe. Some moves to the
front: Mr. Chrestman, Pezzola & this
defendant Mr Nordean. Judge Howell: Is that
how he got into the Capitol? A: Yes, through
the West Plaza.
Chief Judge Howell: You say they had
military style equipment. What did you mean?
AUSA: Helmets, for example. We used the term
para-military. They were armed with the radio
equipment.
Chief Judge Howell: You said it was encrypted.
Is that a bad thing? AUSA: These radios are
programmable, to three digits. No one will
stumble across it.
Judge Howell: You say he's a risk of flight,
citing a passport of another man found by his
bed. The defense says it was in his wife's
jewelry box. That is unusual.
Chief Judge Howell: He used fighting words, to
stop the democratic process. He said, "Fight
now or lose everything." On Jan 4 he ominously
foreshadowed what would happen and said, "We
are coming for them."
CJ Howell: They weren't coming to be
typical tourists. They had tactical vests.
They were prepared for a violent
confrontation. He was a ringleader. The
government says he had "war powers" but that's
unclear. The government has back-tracked...
Chief Judge Howell: Other people in the crowd,
not necessarily the Proud Boys, broke into the
Capitol. This is not unlike other cases where
people did damage and the Government did not
seek to detain them.
Chief Judge Howell: He has a number of
troubling characteristics, as a leader of the
Proud Boys. He has strong ties to him
community. He did have this passport, in his
house. It's a close case, but this Court find
he can be released.
