McCaughey III
had a
proceeding before
District Judge
Trevor N.
McFadden,
and opposed
both complex
case designation
(pending) and
the exclusion of
time under the
Speedy Trial
Act. (That exclusion was
granted). The
complex case
issues is an
emerging
one, and his
lawyer Lindy R.
Urso spoke
about a witch
hunt. Inner

lawyer says
this is not
the largest
investigation
in DOJ history
- it is the
biggest
political
witch hunt. He
says there is
no public
outcry that
DOJ collect
& watch
more
video.
McCaughey is
in detention.

terms of
discovery, all
they gave us
back are his
phone and
public links.
Is that all
they showed
the Grand Jury
to get this
indictment? We
oppose the
motion.

There's a lot
of overlapping
discovery. It
will take a
while
McCaughey's
lawyer: He's
charged only
for events in
that little
West tunnel.
So discovery
should be
simple. This
should not be
joined with
all the other
things that
happened on
the Capitol
grounds that
day. Judge
McFadden: In
that video,
there's 100s
of protesters
McCaughey's
lawyer: The
quandary is
caused by the
government
itself.
Normally the
US
investigates
before they
arrest &
detain. Judge
McFadden:
Arguably,
those who
associate
themselves
with jobs are
creating some
of the
complexity.
When would you
like to come
back?
McCaughey's
lawyer:
Another three
or four weeks.
We oppose the
exclusion of
time under the
Speedy Trial
Act. Judge
McFadden:
Let's come
back in 45
days. The
government is
going to make
plea offers, I
hope by then.
It's hard to
schedule jury
trial due to
COVID.
Judge
McFadden:
Sounds like
you're willing
to forego some
of the
discovery,
just to focus
on that
tunnel. How
about May 4?
I'm excluding
time, and not
ruling yet on
the complex
case issue.
