the U.S. Senate, accused
insurrectionist Domenic
Pezzola was ordered
detained until
trial by
Magistrate
Judge Robin M.
Meriweather.

flight, and
obstruction.
He microwaved
his
electronics.
He went to
Boston, and
tried to go to
Switzerland,
he said he
couldn't be
extradited and
could "ski for
a few days."
He had the
foresight to
delete
information
about his
conduct
Judge:
I'm going to
have to take
the hard break
for 15
minutes, then
I'll let the
defense
respond. OK -
it's 12:30 and
DDC Sullivan
just returned,
apologizing.
Defense: The
Government
purports to be
inside my
client's mind.
But they can't
do that.
Sabol's
lawyer: I have
an audio of my
client saying,
Don't hurt the
cop. [Plays it
- a woman's
voice also
says it.]
Court
reporter: I
couldn't hear
you. Judge
Sullivan: Yes,
we couldn't
hear you.
Defense: I
have a
military
witness who
says it's my
client saying,
Don't hurt the
cop. We'll
have that
witness at
trial.
Defense:
Mr Sabol acted
on fear and
paranoia. He
was ashamed
and tried to
slit his
wrists. He
believes he
was going to
be charged
with sedition.
So the Court
has a
difficult
decision. We
have 30
character
letters.
Defense:
Send Mr. Sabol
back to NY, to
his
girlfriend's
house. He used
to disarm
munitions for
US military.
He won't do it
again. He'll
stay home and
be a good
citizen.
Judge:
You have a
senior
Probation
officer who
would
supervise in
NY? Was it in
your papers?
Defense:
It's Bill
Parker of NYND
Probation. He
said, he would
be responsible
to verify the
address. I
have a name
& direct
number.
AUSA: I don't
think we have

which the

what the
Syracuse
newspaper says

Mr Sabol is
distinguishable
from the
Munchel
decision.

Sullivan: The
media wrongly
attributed the
decision to
Chief Judge
Howell, it was
actually Judge
Lamberth... I
like to be
upfront, on
this bond
hearing. What
is Mr Sabol's
position on
Speedy Trial?
Defense:
My client has
been detained
for 76 days.
He's not
prepared to
address [agree
to] excluding
Speedy Trial
Act time
today.
Judge
Sullivan: My
inclination is
to deny the
motion [to
release
Sabol]. But I
haven't
finally
decided. I'll
leave the
motion in
place
AUSA:
I'll file on
Speedy Trial
exclusion next
Tueday.
Defense: I'll
respond by
Thursday.
Judge: Can the
government
reply by
Friday at 4
pm? OK, I'll
mute the video
and audio and
talk again in
10 minutes.
Judge
Sullivan is
back. He says:
"I'm going to
keep Mr. Sabol
detained.
Everyone will
get a lengthy
opinion
shortly,"
which may
benefit also
my colleagues.
