FEDERAL COURT,
April 12 – Minutes
into a break in the
impeachment trial in
the U.S. Senate, accused
insurrectionist Domenic
Pezzola was ordered
detained until
trial by
Magistrate
Judge Robin M.
Meriweather.
Inner City
Press live
tweeted it, below. There
was an appeal.
Now on April 12,
after the DC
Circuit's
decision in US
v. Munchel,
Judge Emmet
G. Sullivan held a proceeding on
and with defendant Jack
Wade Whitton.
Inner City Press live tweeted
it, here:
Assistant
US Attorney:
I'll pause the
video at 41
seconds. He'll
see his
baseball cap,
with his hand
on Officer
B.M. out into
the crowd....
Now at 45
seconds, he
has succeeded
dragging
Officer B.M.
out, and
co-defendants
Mullins and
Lopatic
assault him
AUSA:
Now I'm going
to show you
another
assault by the
defendant,
that is not
yet charged...
The defendant
is not as
clearly
visible here,
because you'll
be viewing him
through an
opaque police
shield.
AUSA:
The defendant
was heard to
yell, to the
police, You're
going to die
tonight.
Judge
Sullivan: I
did not hear
any utterance.
AUSA: It's on
the body worn
camera
footage. Let
me know you
another file,
GX 6.
Judge
Sullivan: Does
the government
intend a
superseding
indictment?
AUSA:
Yes.
Defense:
That's for
helping me get
into your bar
association.
Judge
Sullivan: If
you have the
$200, you're
welcome in.
[Joking, it
seems fair to
say]
Defense:
My client runs
a business, he
is not a
member of the
Proud Boys. He
did not
coordinate or
premeditate,
no tactical
gear or
zip-ties. No
social media
posts before
or after
espousing
violence.
Defense:
He has only
three
misdemeanors,
one of which
involved
fishing,
nothing to do
with a riot at
the Capitol.
Judge
Sullivan: I
meant to ask,
No prior
felonies...
These cases
are difficult.
The letters
say he is a
pillar of the
community.
AUSA:
He said, I'll
stay off
social media
for a while.
He still
espouses those
views. And
there are
opportunities
for him to
continue to
act out.
There's no
statement of
remorse or
renouncing the
values that
brought them
there that
day.
Judge
Sullivan:
Defendant is
not required
to say
anything. So
what can we
read into him
not saying,
I'm sorry?
AUSA:
He has not
renounced his
mentality, he
is still poses
a threat.
Judge
Sullivan: I'm
going to issue
a written
opinion, on
whatever
decision I
make.
Judge
Sullivan: With
respect to
this bond
issue,
decision in
the next
couple of
days. I'll say
I'm inclined
to order
continued
detention. And
it would take
the Marshals
some time to
bring him
here. Maybe he
should stay in
detention in
Georgia.
We will
have more on
this.
