On June 11,
months
after the DC
Circuit's
decision in US
v. Munchel, DDC
Magistrate Zia
Faruqui
held
a
proceeding on
Pauline Bauer.
It did not go
well. Inner
City Press

He
ordered Bauer
to appear in
person on June
18, pushed
back to June
21 by the observance of
the Juneteenth
Federal
holiday.
On June
21, Judge
Faruqui held an in-person
proceeding
with Bauer -
and detained
her for
criminal contempt.

June 22, after
Bauer spent
the night in
DC Jail at
1901 D Street,
SE, she
appeared again
before Judge
Faruqui. Without
signing
anything, and
saying she would
drive to
Mount
Rushmore from
June 30
to July 15,
she was
released.

Now weeks
later, the
assigned
stand-by
counsel has
disclosed that
Bauer
has still not
been given
access to her
discovery,
videos.
Apparently,
the US
Attorney's
Office for DC,
which gives USAfx
access to
select media,
hasn't given
this defendant
(or other Press
which
have requested)
any access.
What is going on
here?
"Counsel has
sent an email
to Ms. Bauer
advising her
of the
discovery
production.
However
the videos
themselves are
too large to
email.
Accordingly,
there are
several
options for
providing Ms.
Bauer with the
discovery.
Either the
government
could grant
access to Ms.
Bauer to the
USAfx
platform; or
it could
upload the
videos and
other
discovery onto
an external
hard drive or
USB flash
drive and mail
these directly
to Ms. Bauer.
Alternatively,
undersigned
counsel could
undertake the
responsibility
of delivering
the materials
to Ms. Bauer
by mail or by
uploading the
discovery to a
secure cloud
based platform
similar to
USAfx but
whose access
is not
controlled by
the USAO. 3
Counsel awaits
the Court’s
direction on
the role it
wishes standby
counsel to
undertake on
discovery and
other pretrial
issues."

until your
court case is

you.

order. Is
