Judge
Amit Mehta
held
a
proceeding
on OathKeeper
Jason Dolan,
and denied DOJ's
request to
keep him
locked up
pending trial. Inner

Dolan is
charged with
destruction of
government
property.

Mehta: Let me
cut to the
chase. This is
a close call.
Two aspects
weight against
Mr. Dolan. His
participation
in bringing
guns to the
hotel, where
Quick Reaction
Force was set
up. They
returned to
the hotel on
Jan 7, with
three long-gun
boxes.
Judge
Mehta: Also, I
am convinced
Mr. Dolan
possesses
weapons, the
neighbor says
multiple
weapons. His
wife was
carrying an
AR-15. And a
third: on
January 6,
though he says
he didn't
destroy
property. But
why did he
walk toward
House
Speaker's
Office?
Judge
Mehta: All of
that said, I
don't put Mr.
Dolan in the
same category
as the other
defendants in
his case,
including Ms.
Watkins.
Judge
Mehta: Here,
we do not have
the
communication
showing state
of mind. Other
said they were
"looking for
the Speaker."
But for Dolan,
the
communications
are not there.
And he did not
really
communicate
with the
OathKeepers
after January
6.
Judge
Mehta: He has
no prior
criminal
history. 20
years in the
Marines. By
contrast, Mr.
Harrelson used
a gun to shoot
at his
neighbor's
dog. So, I
deny US
motion,
they've fallen
just short of
the line for
detention.
Judge
Mehta:
Conditions
including no
weapons in the
home, if has
control of
weapons
outside the
home, turn 'em
over to the
FBI through
counsel. Next
is July 2nd at
