In DC Insurrection Case, Hearing on Robertson's Detention For Gun and Now Fuzes

FEDERAL COURT, July 14 -- On July 9 months after the DC Circuit's decision in US v. Munchel, DDC Magistrate Judge G. Michael Harvey had before him Capitol breach defendant (and 27 year police veteran) Thomas Robertson, on a no-bond warrant signed by Judge Christopher R. Cooper, for guns.

  Robertson's lawyer tried to get him released, but the Assistant US Attorney described a gun in the bedroom, and four silencers. Robertson was detained by Magistrate Judge Harvey, at least until a hearing before Judge Cooper the date of which has not yet been set. On July 12, Judge Cooper set a July 14 hearing: "MINUTE ORDER as to THOMAS ROBERTSON (1): The Court hereby sets a hearing on the [30] Motion to Revoke Release Order for July 14, 2021, at 4:00 PM by videoconference. Video connection information will be provided to the parties separately. Signed by Judge Christopher R. Cooper on 07/12/2021."

Now on July 14, before the 4 pm hearing, the US filed this: "The United States submits this supplemental brief to bring to the Court’s attention additional information that may be relevant to the pending motion to revoke the Defendant’s conditions of release. Law enforcement continues to review the items seized from the home of Defendant Thomas Robertson on June 29, 2021. This review uncovered the blue, silver and brown items identified by evidence tag 35, depicted below. They are visually consistent with M228 fuzes that have not been fired, and are pending further investigation to confirm whether they are inert. M228 fuzes are federally regulated explosives."

From July 9: Magistrate Judge Harvey: The government alleges that you, Mr. Robertson, ordered firearms, and had a pipe bomb in your house. This while you are charged with a felony. You face up to 5 years on this.

Assistant US Attorney: We ask that Mr. Robertson be held in detention under Judge Cooper can adjudicate this. 

Judge Harvey: Counsel for the defense? Defense lawyer: We ask for his release. We filed a response to US' motion. The no bond warrant has not affidavit

Defense lawyer: Mr. Robertson had 27 years on a police force. He's not a risk of flight. This court can set conditions of release, that he not touch any weapons.

AUSA: A gun was found in his bedroom. And four silencers in his name - they are classified as firearms under federal law. This defendant was before you before, last time guns were found in his house in the Western District of Virginia.

AUSA: No condition could be set without risk of violation. He's blatantly refused to comply. Judge Harvey: Thank you for reminding me of the prior proceedings. I have discretion - but I'm influenced by the what the District Judge did, if anything has changed.

 Judge Harvey: I will detain Mr. Robertson until the next hearing before Judge Cooper. I'm sure he'll hear it next week. Anything further?

AUSA: No. Defense: No.

Judge Harvey: The parties are excused.
