FEDERAL COURT,
July 14 --
On July 13,
months
after the DC
Circuit's
decision in US
v. Munchel, DDC
Magistrate Judge G.
Michael Harvey
had before him
Capitol breach
defendant Robert
Morss -
and his
parents.
Both parents
testified
under oath,
about a road
trip with
Robert and his
substitute
teaching after
graduating
from Penn
State. The US
brought
up new
text messages
about a
tactical vest that
carried
armored
plates. Morss
and his lawyer
will get that,
and redacted
into the
docket, then
reconvene.

14, Magistrate
Judge Harvey
continued the
hearing, but
there were
more questions
about videos
that the US
Attorney's
Office has not
provided even
to the
court, while withholding
them from the
public. Inner

video --

lawyer: He is
in the back,
he passed

Morss'
lawyer: There
are six
defendants on
this
indictment and
all but one
have been
released. All
Mr. Morss
wanted to
attend was a
historic
event. Yes, it
got out of
hand.

lawyer:
TRISTAN
CHANDLER
STEVENS was in
the tunnel -
and he was
released. And
the individual
named Lee, he
was in the
front line and
threw a lit
object, a fire
cracker,
toward the
direction of
the police
Morss'
lawyer: My
client is 28,
he got his
college degree
in December
2020 and got a
job. Sure he
moved in
January - he
got a job with
a school
district, he
moved there
and signed a
lease. Then
the FBI came
in the early
morning hours
when he was
headed to work
Morss'
lawyer: These
writings of
his the
government is
putting in,
there's no
indication of
when they were
written. He
just wanted to
be a positive
force for his
students. You
can release
him with
strict
conditions.
His mother and
father, they
are a strong
family

Harvey: Have
you seen the
journal?
Morss'
lawyer: I've
seen what's in
the US's
pleading, that
all. We have
not seen the
journal. AUSA:
Defense
counsel
mentioned us
providing the
video - we
have only
given that
which is
public
available. Not
the bodyworn
AUSA:
Defense
counsel
misstated the
facts about
many
co-defendants
Judge Harvey:
Then restate
it. The
Circuit in
Munchel tells
us to compare
defendants.

inaccurate.
AUSA: There is
no Lee. It is
Judd. He threw
a fire
cracker.
AUSA:
We don't have,
for him, the
"how to build
a militia"
entries. Mr
Stevens was in
the tunnel
from 240 to 4
pm. He pushed
against the
line and used
a shield -
organized by
Mr Morss. We
had less
evidence of
planning, no
walkie talkie
or plates or
kits
AUSA:
For Mr.
MCCAUGHEY -
it's "McCoy,"
it's often
mis-pronounced
- we had
evidence of
planning but
no walkie
talkies or
medical kits,
no military
training. Two
are held, one
stole a baton
- oh, we
should be
careful, we
don't know
that.
Judge
Harvey: Any
military
training?
[It's sounds
to some that
military
service makes
it more likely
for a
defendant to
be detained]
AUSA: I came
to the office
just for this
and it still
doesn't work.
AUSA:
Co-defendant,
CHRISTOPHER
JOSEPH
QUAGLIN, he
was released
in New Jersey
and we
appealed it to
the Chief
Judge. He
rented
additional
rooms in DC,
had some
association
with a
self-described
Proud Boy. He
had a gas
mask.
AUSA:
Morss only
seemed to
express
remorse when
he thought he
would be
caught. "The
ramifications
of the 6th are
coming down on
me."
Judge
Harvey: I want
to see the
videos. Why
haven't you
provided them?
AUSA: I'll
just have to
get
permission.

not public?

of the body
worn, only
stills.
Judge
Harvey: The
defense says
that the
publicly
available
video is
inconsistent
with what you
proffer. I
think you
should produce
the rest.
AUSA: I don't
believe it
would take

lawyer: Can we
get it?
Next hearing,
next week.
