July 20 --
On July 13,
months
after the DC
Circuit's
decision in US
v. Munchel, DDC
Magistrate Judge G.
Michael Harvey
had before him
Capitol breach
defendant Robert
Morss -
and his
parents.
Both parents
testified
under oath,
about a road
trip with
Robert and his
substitute
teaching after
graduating
from Penn
State. The US
brought
up new
text messages
about a
tactical vest that
carried
armored
plates. Morss
and his lawyer
will get that,
and redacted
into the
docket, then
reconvene.

considered videos
and purported
to order to
make them
available to
the public -
but they still
are not,
confined to a
password
protected DOJ
platform USAfx, see
below, even as
Judge
Harvey
detained
Morss.
On
July 14, Magistrate
Judge Harvey
continued the
hearing, but
there were
more questions
about videos
that the US
Attorney's
Office has not
provided even
to the
court, while withholding
them from the

pm, after
Inner City Press
emailed Judge
Harvey and his
chambers about
the non-public
availability
of the used
videos, Judge
Harvey ordered
Morss
detained, with the
videos still
withheld.

believe he is
a risk of
flight, but
the government
has shown he
is a danger to
the
community."
The government
points to his
texts he sent,
saying he was
considering
leaving the
country
because the
government was
"crushing"
everyone. Mr.
Morss was
arrested 6
months later,
in his home,
in
Pennsylvania.
But in terms
of danger,
it's
complicated
Judge
Harvey: I have
reviewed all
the videos and
make the
following
findings
[on judicial
documents that
should be made
available to
the public at
large] He
entered after
rioters tried
to push
through a
fence. Mr
Morss grabs a
baton. Gov
Exhibit cited... His
tactical vest
has armored
plate. He
wrote that
he'd be
bringing his
"plate
carrier." He
was wearing
body armor on
January 6. He
had a knife- I
don't know why
a person would
need that for
a peaceful
protest. At
one point in
the video he
is pushing
Judge
Harvey: The
government's
evidence is
strong, with
surveillance
videos, body
warn camera
videos... He
is a veteran,
3 tours in
Afghanistan,
with untreated
PTSD. But he
used his
training for
this. In
Munchel, we're
told to
consider
resources and
capabilities
Judge
Harvey: This
was not a
momentary loss
of reason. His
conduct lasted
over hours.
His release
would pose a
danger. He may
try to form a
militia. I
remand Mr.
Morss to the
Marshals.
