Former NYPD Valerie Cincinelli Pleads to Obstruction Not Murder For Hire Still Detained

EDNY COURT, April 16 – Valerie Cincinelli, the former NYPD officer charged with murder for hire and obstruction of justice, got a deal to plead guilty to only the latter charge. On April 16 she pleaded guilty, and the US Attorney's Office oppose her release pending sentencing in October. Inner City Press live tweeted it, here:

Judge Joanna Seybert: Ms. Cincinelli, you have been produce here today [from the MDC] for a disposition, correct? Cincinelli: Yes.

Judge: How far did you go in school, Ms. Cincinelli?

 Cincinelli: I went to college. I have a B.A.

Judge: Your plea deal says you have to plead by November 13, 2020, I assume that will be corrected... You could not appeal if you get a sentence of 63 months or below

Judge: The US is saying, if you plead guilty, they will dismiss the other counts, correct? AUSA: Correct. [She is pleading to obstructing grand jury]

Judge: That is conditional on US not learning more, or you violating the deal.

 Cincinelli: I understand.

Judge: What did you do that makes you believe you are guilty?

Cincinelli: I deleted images on iPhone with intent to obstruct investigation of murder for hire

AUSA: The defendant was a police officer... her intent to avoid apprehension by discussing an alibi. We have audio and video.

Judge: How do you plead to Count 3?

 Cincinelli: Guilty. Judge: Sentencing October 29, 11 am. You've been in custody how long? Cincinelli (crying) Two years, I haven't seen my son.

 AUSA: We do not agree to release pending sentence.  Defense: We can propose a $2 million bail package. AUSA: Post conviction release is MORE stringent.  Judge: Who would be putting up the bail money?

AUSA: Her own emails shows she was dissembling about conditions of confinement in MDC. I'll note additionally, she's been in 23 months, less than half of the guidelines. The government intends to seek an above guideline sentence.

AUSA: Murder for hire has a ten year maximum, this has a 20 year maximum.

Defense: Ms Cincinelli did not commit murder for hire, only obstruction. We'll say more at sentencing. This honorable Court is not required to honor the US request for above guidelines

Judge: Send to my chambers the prior submissions. And the emails that were mentioned. Sooner rather than later.  We are adjourned.
