EDNY COURTHOUSE,
August 29 – Charles Powell is
in the Metropolitan Detention
Center in Brooklyn awaiting
trial before U.S. District
Court for the Eastern District
of New York Judge Eric R.
Komitee.
But with a
switch in Assistant US
Attorneys, from Jack Dennehy
on "indefinite leave" to
Andres Palacio (who thus
described the leave),the
prosecution on August 29 asked
for an adjournment of trial.
In a
proceeding covered by Inner
City Press, Judge Komitee
said, in essence, not so
fast.
Defense
counsel pointed out that the
new AUSA is asking for delay
in favor of a November trial
on a defendant who is not in
custody, before Judge Diane
Gujarati.
Judge Komitee
asked for a filing by August
31, at midnight - and then
inquired into the defendant's
appearance at the time of
arrest and now, and the US'
Brady obligation.
Then his
dog barked.
Judge Komitee
said that he was not in the
office - but still his
questions dug deeper. Inner
City Press will continue to
follow this case, in its new
EDNY project.
The case is US v.
Powell, 21-cr-572 (ERK)
