In EDNY Marina Golfo Charged
With Defrauding Dept of Health Mulls Challenge
to Phone Records

EDNY COURTHOUSE,
Jan 3 – Marina Golfo billed
the New York City Department
of Health for hundreds of
Early Intervention Program
sessions with developmentally
disabled children from ages 1
to 3. But according to the
complaint filed against her in
the U.S. District Court for
the Eastern District of New
York, her cell phone shows she
was either speaking on the
phone, or not present, for
these sessions.
On January
3 before EDNY Judge Kiyo A.
Matsumoto, Golfo's lawyer
Edward V. Sapone, who also
practices in the SDNY, said
that he might make a Franks
motion to suppress some or all
of the contents of Golfo's
cell phone records.
Judge Matsumoto, On what
basis?
Sapone said he was still
studying it. He rejected a
February trial date saying he
has another trial. Judge
Matsumoto countered that the
EDNY has five judicial
vacancies and she has many
civil motions to rule on, then
a seminar for judges and other
meeting in Washington.
So the
trial is not on until June 22.
