New CJA Won't Understand in EDNY

EDNY COURTHOUSE,
Sept 12 – Tae Jung Kim is
charged with health care fraud
as owner of CNS Physical
Therapy & Acupuncture,
P.C. of 108-25 63rd Avenue,
Forest Hills, NY. He wants to
plead guilty but his lawyer
Nathan L. Dembin is so sick he
can't come to court.
On September 12, U.S. District
Court for the Eastern District
of New York Judge LaShann
Moutique DeArcy Hall held a
proceeding. Inner City Press
on the EDNY beat covered
it.
A request
was made, but only by phone,
to EDNY Magistrate Judge Vera
M. Scanlon to appoint a free
CJA lawyer to appear before
her on September 13 for Kim to
waive indictment.
Assistant
US Attorney John Vagelatos
said he office wanted the CJA
appoint in order to meet a
Speedy Trial Act deadline of
September 17 (already pushed
back six times, he said).
The
District Judge said the
request should have been made
in the docket, and that she
would try to issue an order
appointing the CJA counsel on
duty at EDNY today to
represent Kim and waive
indictment.
Then Kim spoke up
and said that another lawyer
would not be able to
understand his situation. And
so, a more formal letter will
have to be submitted.
The EDNY case is
US v. Kim, 22-cr-343
