Huawei Criminal Case Has Demand For Bill of Particular On IEEPA Transactions Via HSBC

FEDERAL COURTHOUSE, Feb 18 – The Chinese government and its state own firms have managed to buy the United Nations and / through its Secretary General Antonio Guterres, but in the US courts at least for now things are different. Previously in December 2019 from the EDNY: "The Government's motion to disqualify James M. Cole is granted. The Court's decision has been submitted to the Classified Information Security Officer for service to the Government by hand. The decision will be reviewed for classified information by the relevant agencies, and a redacted decision will be made public by January 10, 2020. Sidley Austin LLP should take prompt and reasonable steps to address all issues arising from Mr. Cole's conflict. Ordered by Judge Ann M. Donnelly on 12/3/2019."

EDNY Judge Ann M. Donnelly asks about the status of discovery. Defense lawyer Green: AUSA Solomon's assessment that the first tranche is substantially complete, that's kind of an elusive goal. We have been trying to see if that is the case.

Defense lawyer: We always hear that the government is still looking. At some point they need to say, the first tranche is complete. There are Brady issues. We have made requests. Much of what we have received was insubstantial and unusable.

Huewei is moving for a bill of particulars.  Huawei's lawyer: There's a submission in the Canadian proceeding. It asserts that HSBC clearer $100 million in Skycom transactions to the US.

Huawei's lawyer: Given the Canadian extradition proceedings, they should identify to us which transactions they are focused on. AUSA: A bill of particulars is supposed to be a preview of the case, not what's useful to the defense, transaction by transaction.

AUSA: We point to spreadsheets. We specify the IEEPA transactions, the wire fraud count.  Huawei lawyer: We say they haven't done enough. Huawei may be unable to prepare its defense.  Judge Donnelly: Is there anything you all can agree on?

Judge Donnelly: I'd like the parties to let me know in a month what you can agree to, to narrow the things I have to think about. Let's get together on May 18. I'm sorry to say but it will probably still be by telephone.

  Oh the conflicts of interest at the UN, where Guterres is linked to CEFC China Energy, were so easy. Banned from even entering the UN by corrupt Guterres, Inner City Press is covering the courts and going elsewhere to ask questions.

   When Spain's Economy Minister Nadia Calviño took questions in New York on October 16, on her way to Washington for the IMF - World Bank annual meetings, Inner City Press went and asked her two questions. On the question of Spain's refusal to extradite alleged narco money launder Hugo Carvajal -- Inner City Press has been covering the Honduras narco-politics trial in the SDNY courthouse -- she said "I will not make any remarks on an individual situation, of course." But in her opening dialogue with Rob Cox of BreakingViews, Minister Calviño had spoken of Spain's progress with 5G. Inner City Press asked her about Huawei's role and whether US sanctions against the company have had any economic impact.

     Minister Calviño spoke of auction the spectrum but acknowledged a need for "security," directing Inner City Press to a week-old report by the European Commission. We'll have more on this.

  The prosecution of the brother of Honduras' president for guns and drug running began with a bang on October 2 with the charge that already life imprisoned El Chapo Guzman gave the defendant $1 million for this brother, the president.
