SDNY, July 12 – On Day 3
of the Schulte jury deliberations, Kurt
headed up to the 15th floor around 10:30
am. There had been a jury note.
In the
courtroom, Schulte's two in-person
standby counsel were whispering to him.
The note,
it emerged, was about what was a
"substantial step." It was in the
instruction about Schulte's alleged
attempted transmission of National
Defense Information from inside the MCC
jail.
Was
drafting a tweet that was never sent a
"substantial step"? Would putting it in
a tweet-on-delay service change
that?
Stand-by
counsel put in a phone call to Ed Zas,
still with the Federal Defenders,
described on a guru. After a break,
Schulte made some suggestions, and got a
few in.
The
jury entered, again not looking at
Schulte.
Judge
Furman read the agreed answer to them.
They would also get redacted copies of
the Berger testimony. Were they close?
Not by 5 pm.
Kurt was
still looking into the Special
Administrative Measures imposed by
then-AG Jeff Sessions and, he was told,
