SDNY COURTHOUSE,
May 17 – The Fairbridge Inn
and Suites in Highland Falls
in Orange County, New York,
has been sued under the
Americans with Disabilities
Act.
Plaintiff
Saim Sarwar lives in Florida
and has limited use of her
hands; she is visually
impaired and relies on a
wheelchair. She visited the
website of the property "but
was unable to do so."
She sued, via a
firm in Newton,
Massachusetts.
The case has been
assigned to U.S. District
Court for the Southern
District of New York Judge
John G. Koeltl; Inner City
Press dug it up in the docket.
On May 17, Judge
Koeltl held a proceeding and
Inner City Press covered it.
The hotel did not appear, and
Judge Koeltl discussed with
plaintiff's counsel the filing
a motion for default judgment.
He gave extra time in part
because the lawyer cited being
"knocked down" by COVID
vaccine side effects.
Strangely, there was some
early discussion, still, of
service of process.
The case is
Sarwar v. Wabno Hotels, Inc.,
21-cv-43 (Koeltl)
