SDNY COURTHOUSE,
May 30 – A youth named J.T.
was sexually abused from
February 2017 to June 2018 in
an after-school program in
P.S. 57 managed by the
YMCA.
The
abuse was by a YMCA employee,
but the City of New York is
legally responsible. The City
has sued its insurer
Philadelphia Indemnity
Insurance Company for
coverage.
On May 27,
U.S. District Court for the
Southern District of New York
Judge Valerie E. Caproni held
a proceeding. Inner City Press
covered it.
Judge
Caproni asked the parties if
they might settle the case.
They said no - they need a
judge to determine the meaning
of the insurance contract.
Judge
Caproni aid that's what she'll
do then: "that's why they pay
me the big bucks." She said
the City's motion for summary
judgment is due September 9.
The case is City
of New York et al v.
Philadelphia Indemnity
Insurance Company, 22-cv-2248
(Caproni)
