SDNY COURTHOUSE,
May 4 –
William Valdez was ordered
freed on bond on May 1 by
Magistrate Judge Robert W.
Lehrberger of the U.S.
District Court for the
Southern District of New York.
But the US appealed, and on
May 4 the appeal was heard by
SDNY District Judge Katherine
Polk Failla. Inner City Press
covered it.
Here was the
disposition on May 1:
"$150,000 PRB; 3 FRP; Travel
restricted to SDNY/EDNY;
Surrender travel documents
(& no new applications);
Pretrial supervision as
directed by Pretrial Services;
Drug testing/treatment as
directed by PTS; Home
incarceration; Electronic
monitoring; Defendant not to
possess firearm/destructive
device/other weapon. Defendant
to be released on own
signature; Remaining
conditions to be met by
5/8/2020. -Defendant must
self-quarantine 14 days; must
install home monitoring equip
no later than 14 days. -Must
obtain cellphone with video
capability for conferences
with pretrial services. -No
contact with co-defendants
except in presence of counsel.
-Must not possess any personal
identifying information of
others. -Must not open any new
bank or credit accounts or
lines of credit without prior
approval of pretrial
services."
Judge Failla says she has
spoken with Magistrate Judge
Lehrburger "about what he
knew, and about what he
perhaps did not know.... Let's
turn to the 2016
shooting."
Assistant US
Attorney Andrew Chan said, Law
enforcement identified Mr.
Valdez in that shooting.
Judge Failla said to defense
counsel: It is distressing
that you passed on to me
inaccurate information, that
Mr. McBean was taking the hit
for the gun. It is
disappointing.
There were some technical
issues / problems, as these
proceedings remain a work in
progress, here.
But
this was the Order:
