April 22 – Diego Dilan
Rodiguez Ordonez is under 20
years old, in custody with
suicidal ideation and on April
22, 2020 he was ordered
continued to be detained amid
Coronavirus. There is no right
to psycho-analysis.
In a
proceeding before U.S.
District Court for the
Southern District of New York
Judge Alvin K. Hellerstein,
which Inner City Press
covered, his lawyer said, They
put him on suicide watch. He
has a history of self-harm.
But they are taking a
reactive-only
approach.
Questions arose about the
authorities' duties to provide
care.
Judge Hellerstein returned
from a break and ruled: I find
that there has been no
deliberate indifference, and
that there is no
(Constitutional) right to
individualized treatment; 219
F.Supp. 3d 1100 does not say
what it was presented for.
The petitioner's lawyer
apologized for citing the
wrong case, the intent had
been Braggs v. Dunn, 257
F.Supp. 3d 1171. Judge
Hellerstein said it did not
change his decision, and
allowed some sealing of the
record.
The case is
Rodriguez Ordonez v. Wolf et
al., 20-cv-1727
(Hellerstein).
