SDNY COURTHOUSE,
Nov 27 – The case of Bouchard
Transportation Co., Inc. v.
Laurel Shipping LLC et al is
one that had essentially
already settled when on July
21 U.S. District Court for the
Southern District of New York
Judge Mary Kay Vyskocil held a
proceeding. Still,
counsel did not want to
dismiss the case, saying that
the final payment had not been
made.
Judge Vyskocil
was having none of it. She
told the parties she would
issue an order dismissing it.
What was the
prejudice?
Having a
make a filing to re-open if
the final payment wasn't made,
was the answer.
Judge Vykocil was
unmoved. She said she would
issue an order, now to be
co-drafted, with the
opportunity to re-open if the
representations made at the
conference are not followed
through.
