SDNY COURTHOUSE,
July 11 – Zachary Ballard is
imprisoned with a release date
of April 13, 2051 for a series
of armed robberies. But, he
points out seeking
compassionate release, no
shots were fired and no one
was physically
injured.
The long
sentence is due to stacking,
now ended by the First Step
Act but only prospectively,
not for Ballard's case and
other like
him.
On July 9, U.S. District Court
for the Southern District of
New York Judge Jed S. Rakoff
held a proceeding. Inner City
Press covered it.
Judge
Rakoff reminisced about his
time as a Criminal Justice Act
defense lawyer. Since the
government had cited Ballard's
non-vaccinated status against
him, he said he'd like to hear
more on that.
He said he
would rule on the motion for
compassionate release by the
end of August if not soon.
