Anthony
Debellis was
working for
the NYC
Departing of
Citywide
Administrative
Services in
2017 when he
was accused of
stealing or
attempting to
steal City
property from
350 Marconi
Street in The
Bronx. He was
acquitted of
that, but only
after spending
months in
jail. He sued.
On
November 7,
2022, U.S.
District Court
for the
Southern
District of
New York Judge
Jesse M.
Furman held a
proceeding.
Inner City
Press covered
it.
Judge
Furman in
March has
dismissed all
claims except
one regarding
a search. The
City has
indicated it
will move for
summary
judgment on
that once
discovery is
completed.
Judge Furman
told the
City's lawyer
to be sure to
serve
Debellis, as
he is not on
ECF.
Debellis
said he does
not understand
how he can
have been
falsely
accused, have
spent time in
jail and lost
his job of 15
years, and
there's no
accountability.
Judge Furman
replied that
the law
correctly
require more
than acquittal
but rather a
finding that
there had been
no basis to
prosecute him.
The
case, or at
least the
single claim,
continues.
