SDNY COURTHOUSE,
May 14 – Jonathan Castle was
charged with being a felon in
possession of a firearm. Then,
the government also cited his
appears in a music
video.
On May 14, U.S. District Court
for the Southern District of
New York Judge John G. Koeltl
held his sentencing. Inner
City Press covered
it.
Castle's lawyer
said the music video was
outside, and the gun in it was
a prop. The AUSA spoke of
another gun, thrown to the
ground and therefore more
dangerous.
The sentencing
guideline was 18 to 24 months.
Judge Koeltl sentenced Castle
to a year and a day,
permitting credit for "good
time."
The court
reporter asked for the
spelling of his children, whom
he mentioned when he spoke
before sentencing.
Should music
videos and other First
Amendment protected activity
be cited at sentencing?
The case is US v.
Castle, 20-cr-556 (Koeltl)
