SDNY Defamation Plaintiff Served Subpoenas After Magistrate Quashes Asks Again on 3

SDNY COURTHOUSE, June 10 –  Gregory Sheindlin sued James Brady for defamation. But there is more to the story.   

   On April 2, U.S. District Court for the Southern District of New York Judge Lewis J. Liman held a proceeding. Inner City Press covered it. 

  Brady asked loudly why the case had been assigned to Judge Liman, who he said had dismissed his case and called it vexatious litigation.

 Judge Liman stated calmly that he is not required to describe the individual assignment system.

Brady insisted that $1.7 million had been stolen from him. Judge Liman asked what relief Brady was seeking, then denied it. Soon the half hour was up.

But on May 14, Judge Liman held another conference, and Inner City Press again covered it, this time live tweeting, here:

  Judge himself has been subpoena-ed by the plaintiff, as have Cy Vance & other NYS judges, all represented in today's proceeding. Judge

Liman says he has stayed the subpoenas, including on himself and will refer the matter to the Magistrate Judge. Brady: Which one? [He names three with whom he would not feel comfortable.] He cuts in again

Judge Liman: Mr. Brady, do not talk over me.

Brady: It's disappointing that my rights to subpoena being suppressed by you - why? Judge Liman: I'm not going to answer that, I think it's in my order.

 Brady: I had the right to an extension. You are doing what Mr. Sussman tells you.

Judge Liman: You are risking contempt. Let me hear from the other side. Cy Vance's lawyer: I will submit to the Magistrate, if requested.

Judge Liman says while a letter claims he spoke with Judge Kornreich, he did not.

Instead, she called his Chambers about the subpoena and was told it came from the Office of the Clerk.

On May 26, Magistrate Judge Stewart D. Aaron has issued an order quashing the subpoenas issued against current and former NYS judges and DA Vance, and sua sponte quashing the subpoenas issued to two SDNY District Judges and one (other) Magistrate, as well as to a journalist.

On June 10, District Judge Liman held a proceeding and, on the subpoenas, noted that Brady objects as to three: Phillippe Iffrah, Robert Fass and Kathianne Boniello. Judge Liman gave the plaintiff and Boniello until June 14 to respond, with any reply by June 15. Motions for summary judgement are due July 19.

The case is Sheindlin v. Brady, 21-cv-1124 (Liman / Aaron)
