SDNY COURTHOUSE,
Dec 21 – Dramel Elliot was
arrested as a passenger in a
stolen Hertz rental car and
sued.
On December
21, 2020 U.S. District Court
for the Southern District of
New York Judge Naomi Reice
Buchwald held a proceeding.
Inner City Press covered
it.
Judge
Bachwald asked if the
plaintiff had been driving, or
at least in the driver's seat,
of the car.
It emerged that
New York distinguishes a
moving from a stationary
stolen car.
Also
at issue is whether the repeal
in New York of Section 50-a
changes the Protective Order
and allows the plaintiff to
share discovery
materials.
"The
Manhattan District Attorney's
Office declined to prosecute
the Plaintiff."
So this case is
Elliot v. City of New York et
al., 20-cv-702 (Buchman)
