SDNY COURTHOUSE,
August 15 – Goals Aesthetic
and Plastic Surgery has been
sued for not paying minimum
wage or overtime. They want to
appeal.
On May 27,
U.S. District Court for the
Southern District of New York
Judge Gregory H. Woods held a
proceeding. Inner City
Press covered it.
Judge
Woods on May 20 granted the
motion to certify a class of
current and former
receptionists and patient
coordinators.
Plaintiffs'
counsel opposed any stay
pending appeal, and Judge
Woods declined to certify for
interlocutory appeal.
On June 28, Judge
Woods held another proceeding,
this time on the wording for
notices to be sent to the
seemingly 70 members of the
collective. The differences
between Rule 23 and the FLSA
was explored. Judge Woods
invited a letter listing cases
in which the proposed notice
was found appropriate.
On August 10,
2022, Judge Woods held another
conference, and Inner City
Press again covered it. Judge
Woods granted the defendant's
motion to file a motion for
summary judgment, setting the
deadline at October 10.
Decertification motion may
come later.
