SDNY COURTHOUSE,
June 7 – Building Service 32BJ
Health Fund in Massachusetts
sued Empire Cleaning for
failure to allow an audit of
its books.
On June 7,
U.S. District Court for the
Southern District of New York
Judge John G. Koeltl held a
proceeding. Inner City Press
covered it.
Judge
Koeltl said it was not
unreasonable for the defendant
to suggest the plaintiff
should come to Massachuetts to
examine the book, or pay to
have them photocopied and
sent.
The
defendant said a summary
judgment filing would not be
appropriate, as under the
proposed settlement agreement
it delivered among other
records the employee roster
and W-2s.
Judge
Koeltl said that a status
letter should be filed with
him by June 17.
