FMC Devens Asks For Compassionate Release
Citing COVID Dangers

SDNY COURTHOUSE,
Oct 5 – Americo Massa is
serving time in FMC Devens for
loansharking, extortion and
the death of Joseph
Conigliaro.
On
October 5 U.S. District Court
for the Southern District of
New York Judge Jed S. Rakoff
held an oral argument. Inner
City Press covered it.
Judge
Rakoff asked why Massa had not
exhausted his administrative
remedies with the warden.
Massa's lawyer said that is
not required. Judge Rakoff
said he has at times waived
the 30 days of waiting.
But the
application
itself? The
Assistant US Attorney
emphasized the crime; the
defense said the decedent had
been extorting Massa. He also
described Massa's work with
other prisoners with dementia,
whom he said could not
properly wear masks or social
distance amid COVID.
Judge Rakoff
thanked both counsel for their
arguments and said he will
decide in a month.
