SDNY COURTHOUSE,
June 21 – International
Business Times has been sued
for violating copyright in
using a photo of Justin
Timberlake with Alisah
Wainwright, "shocking Jessica
Biel."
On May 28,
U.S. District Court for the
Southern District of New York
Judge Lewis J. Liman held a
proceeding. Inner City
Press covered it.
IBT has
not shown up. Default was
about to be entered, but the
plaintiff's lawyer did not
have a hard copy.
And it being the
day before the three-day
Memorial Day weekend, the
lawyer's paralegal was not
available. So three more weeks
were given.
Now on June 21,
Judge Liman has denied the
plaintiff's motion for a
default judgement, since
Plaintiff did not appear at
the default hearing. It is
without prejudice to refiling
the motion for default by July
30.
The case is
Mockingbird 38, LLC v.
International Business Times,
Inc., 21-cv-283 (Liman)
