worked but were not paid
overtime have sued.
Repeatedly.
On October
1 U.S. District Court for the
Southern District of New York
Chief Magistrate Judge Gabriel
W. Gorenstein held a
proceeding. Inner City Press
covered it.
Judge Gorenstein
is also the Magistrate in
other litigation against the
Bloomberg campaign.
He ruled that
while discovery can proceed in
parallel, once a decision is
issued on the motion for a
stay in the other case.

On December 15,
Judge Gorenstein held another
proceeding, about discovery.
The contents of some email
boxes have been produced.
After argument, Judge
Gorenstein told the parties it
was not a slam dunk either way
and they might want to
compromise until the District
Judge in this case, Judge
Swain, rules on the pending
motion: that is, whether they
can stipulate to conduct
discovery in the next few
months such that there would
not be a need to have the
motion for a stay decided. He
asked for a letter by January
15.
