Abuser Is Released To Home of Mother With

SDNY COURTHOUSE,
April 9 – A defendant accused
of sexually abusing an eight
year old girl sought release
amid the Coronavirus pandemic
from the Metropolitan
Correctional Center in lower
Manhattan, citing
asthma.
Chief
Judge Colleen McMahon of the
U.S. District Court for the
Southern District of New York
in an April 8 telephone
conference asked Federal
Defender Mark Gombiner for the
medical records of his client,
Antonio Brown (not the
receiver, in either sense).
Gombiner replied that given
the Coronavirus crisis it has
been impossible for him to
obtain the medical records but
that Brown has assured him he
has long been asthmatic and
that it is mentioned in the
non-public Pre-Trial Services
report.
Judge McMahon replied that a
hearing should be held, "in
the courtroom."
Gombiner said that because of
his age and hypertension he
has been told by Federal
Defenders not to come in to
work.
Judge McMahon replied that she
is in the SDNY courthouse
every day, "in a mask and
gloves... the most sterile
environment you can imagine."

by SDNY Magistrate Judges in
Courtroom 24B complete with
Purell and social distancing.
Judge McMahon said to expect
an order by the end of the
day. Now on the afternoon of
April 9, this: "AMENDED ORDER
as to Antonio Brown: It is
hereby ORDERED that the
Antonio Brown be released
forthwith pending a hearing on
the outstanding Violation
Petition. Defendant is
ordered o abide by the
conditions of supervised
release imposed at the time of
his sentence, modified today
as follows: (1) Defendant will
be on home incarceration with
Location Monitoring by GPS at
his mother's residence. In
light of the COVID-19
pandemic, the defendant must
remain at his mother's
residence except to seek any
necessary medical treatment,
in each instance with prior
notice and approval by the
Probation Department. The
defendant is to possess or
have access to a telephone
that will allow video
conferencing by the Probation
Department. Defendant is to
report to the Probation
Department at 500 Pearl
Street, 6th floor, following
fourteen (14) days of
self-quarantine to have the
GPS tracker affixed to his
ankle... (2) Defendant must
have NO contact with the
alleged victim chat is the
subject of the pending
violations, or with ANY member
ofthe victim's family.The
violation hearing will be held
on May 20, 2020, at 10:30a.m.
