Arrested In Bronx Amid Order of Protection
Mulled $5000 Settlement in SDNY

SDNY COURTHOUSE,
Dec 1 – Denise Marlin
was arrested by a police
officer of the 52nd Precinct
in The Bronx for, she says,
having an order of protection
violated.
She agreed,
or appeared to agree, to
settle it for
$5,000.
On December
1, U.S. District Court for the
Southern District of New York
Magistrate Judge Ona T. Wang
held a proceeding. Inner City
Press covered
it.
Marlin's lawyer
said the case is trial ready.
The City's
lawyers said it is already
settled and it is time to
enforced the $5,000
settlement, citing the factors
in Winston v. Mediafare,
777 F.2d 78, a 1985 case from
the Second Circuit.
Marlin disputes
that the terms of the alleged
agreement had been agreed to -
saying that it had not been
decided whether to use a
stipulation of voluntary
withdrawal or a stipulation of
settlement.
There is also, of
course, the issue of
attorney's fees.
