SDNY COURTHOUSE,
April 20 –
A multi-defendant asbestos
case was heard on April 20, in
a proceeding covered by Inner
City Press, by U.S. District
Court for the Southern
District of New York Judge
Gregory H. Woods.
Defendant
Armstrong said that its
deponent, living in Buffalo,
did not want to consent to a
deposition because it would
involved contact with one or
more persons from the
"epicenter of the epidemic" of
COVID-19. SDNY
Judge Woods rightfully pushed
back, pointing out that
deposition have been allowed
to be taken by telephone for
more than 20 years.
But
Armstrong's lawyer said that
the deponent demanded to have
presented in person at the
deposition a defense lawyer.
Judge Woods said that would be
up to him, and allowed a
motion for sanctions against
Armstrong to go forward.
That motion is
due April 24, with Armstrong's
response a week after. The
case is Stecher, et al., v.
Aerco International Inc., et
al., 19-cv-8029 (Woods).
