SDNY COURTHOUSE,
Sept 29 – Rocky Defilippo sued
his employer Amtrak for a
spine injury caused when a
piece of ceiling fell on him
in the break
room.
On September 28 U.S. District
Court for the Southern
District of New York Judge
Katherine Polk Failla convened
a telephone conference. Inner
City Press covered
it.
Judge
Failla said while she is not
at liberty to fully describe
the trial slot assignment
process, this case is not the
lead case on October 18, 19 or
20. But it seems the claim for
economic damage is being
dropped.
The case is
DeFilippo v. National Railroad
Passenger Corporation,
17-cv-2789 (Failla)
