Uber Is Sued For Using Criminal History To Drop Drivers Now Discovery Stay Opposed

By Matthew Russell Lee, Patreon
BBC - Guardian UK - Honduras - ESPN

SDNY COURTHOUSE, July 31 – Uber has been sued for unlawfully using criminal history to discriminate against its drivers in NYC, including by race.

On June 30, U.S. District Court for the Southern District of New York Judge Lewis J. Liman held a proceeding. Inner City Press covered it.

The complaint describes Uber using Checkr to dig up a Virginia ticket that was characterized as a misdemeanor - leading to Mr. Golightly being deactivated from the platform without any notice or due process.

Uber is arguing that the drivers are bound by agreements to arbitrate, and to not be in class actions.

Judge Liman split the baby, as he put it, allowing for now limited to discovery to go forward while the motion to compel arbitration is considered.

On July 30, the drivers' counsel filed a memo opposing Uber's motion to stay discovery. The drivers' argue that their proposed discovery is targeted to material issues, citing at least two Lyft cases.

This case is Golightly v. Uber Technologies, Inc. et al., 21-cv-3005 (Liman)
