Insurers Are

Worker But None Knows How He's Doing

Nov 9 – The property owner 622
Third Avenue Company, L.L.C
sued National Fire Insurance
Company of Hartford for not
covering it for the injury of
Jason Vargas who worked on a
construction project at the
building.
On November 9, U.S. District
Court for the Southern
District of New York Judge
Katherine Polk Failla held a
proceeding. Inner City Press
covered it.
Judge
Failla asked, quite sensibly,
how Vargas is doing
physically. None of the
lawyers knew. One said, I'm
not involved in the underlying
state action.
But the
dispute soon became clear: the
insurer argue that Vargas
slipped on water from the leak
in a fire stair coming back
from a bathroom break, not in
connection - they say - with
the contruction project.
Judge
Failla indicated it is too
soon to refer the case to
mediation or a magistrate and
the parties agreed.
