SDNY COURTHOUSE,
Jan 21 – Seaport House,
a restaurant at 229 Front
Street in the South Street
Seaport in lower Manhattan,
sued NYS Governor Cuomo and
NYC Mayor de Blasio for
shutting down indoor
dining.
On January
6 U.S. District Court for the
Southern District of New York
Judge Paul A. Crotty held an
oral argument on the
restaurant's application for a
Temporary Restraining Order.
Inner City Press covered
it.
The
complaint contained a photo of
the front page of the New York
Post of December 12, with a
green faced Cuomo in a Santa
hat, "Cuomo the Grinch who
stole Christmas as he bans
indoor dining
(again)."
The lawyer for
Governor Cuomo cited a 1903
case; Seaport House responded
that restaurants weren't
closed during the Spanish Flu
pandemic of 1917.
Judge Crotty
denied the TRO but set up a
briefing schedule, including
some discovery.
In a
January 21 proceeding Inner
City Press also covered, Judge
Crotty ruled that the
plaintiffs can depose NYS
Heath Department director of
epidemiology Doctor Debra S.
Blog, for three hours.
