LIRR Is Sued By Injured Worker Wanda Benitez Who 3 Years Latter Cannot Return to Work

SDNY COURTHOUSE, Sept 26 – Wanda Benitez, a Machine Operator, sued the Long Island Railroad Company for injuries she sustained on the job on July 2, 2019.

On September 23, 2022, U.S. District Court for the Southern District of New York Magistrate Judge James L. Cott held a proceeding. Inner City Press covered it.

Judge Cott asked if the plaintiff is able to return to work yet. No, he was told, two of her three doctors say do not work.

Judge Cott said depositions are sue by December 9, 2022, with a next conference set for March 16, 2023 at 11 am.

The case is Benitez v. Long Island Railroad Company, 21-cv-10297 (Cott)
