SDNY COURTHOUSE,
May 20 – It was on
CourtCall that on May 20 U.S.
District Court for the South
District of New York Judge
Hellerstein was prepared to
sentence Marino Amaya Duque
for heroin importation. But
there seems to be a problem
with the link, or with Chrome
as opposed to Firefox.
Inner City
Press covered it by phone, as
it has other similar
proceeding, identifying itself
to AT&T as "Inner City
Press, not a participant."
The
US was asking for 70 to 87
months.
Judge Hellerstein asked, Mr
Duque, do you consent to
proceeding by telephone
conference?
Duque, through interpreter,
replied: Yes, I
do.
Judge
Hellerstein recited, My
participation will be by
telephone, due to technical
reasons. Mr Duque was in
prison in Colombia for 19
months, then sent to the US
and in jail for about five
months now. He is entitled to
credit for the five months,
but not the 19 months.
Duque spoke for himself: I
would like to tell your Honor,
I have suffered a lot. I have
problems with my hands, I've
lost some of the sensitivity.
I apologize to the US. I will
not do it again.
Judge Hellerstein said, I find
it difficult to sentence. I'm
not punishing people who are
bad, but who did something
bad. But we can't let people
lose respect for the
law. I sentence Mr Duque
to 36 months in custody, with
five months credit for
detention in US.
The case is US v.
Correa, 17-cr-378
(Hellerstein).
