SDNY COURTHOUSE,
June 25 – The New York State
Department of Correctional
Services has been sued for
violation of rights in
connection with post-release
supervision. On June 25 U.S.
District Court for the
Southern District of New York
Magistrate Judge Robert W.
Lehrburger held a public
proceeding, listed on PACER.
Inner City Press covered
it.
The long standing case,
it appears, is nearing
possible settlement. The
discussion on June 25
concerned the difference in
rights between absconders and
others.
Judge Lehrburger
ruled that by July 9 the
defendants should provide a
list of proposed "subgroups"
of class members, then discuss
it, prior to the next
conference.
The case is
Betances v. Fischer et al.,
11-cv-3200 (Lehrburger).
