Oct 28 – In a Fair Labor
Standards Act case, a question
about attorneys' fees arose
and needed to be
clarified.
On
October 28 U.S. District Court
for the Southern District of
New York Magistrate Judge
Sarah Netburn held a
proceeding. Inner City Press
covered it.
Judge Netburn
asked about the attorneys'
fees. There were apologies,
and clarifications that while
the plaintiffs got only $5000,
the $5000 to the lawyers
weren't all fees but mostly
costs.
Judge Netburn,
citing the ubiquitous Cheeks
v. Freeport Pancake House
standard of review, then
approved the settlement.
The case is
Montana et al v. Pappagiorgio
et al., 18-cv-6594 (Netburn)
