SDNY COURTHOUSE,
April 24 – Charged with the 20
June 2010 murder of David
Moore on 122nd Street in
East Harlem, Jamal Anderson
& Hasahn Murray (who were
17 and 16 at the time) on
April 24 argued that the
charges are unconstitutional.
U.S.
District Court for the
Southern District of New York
Judge Gregory H. Woods made
short work of the argument,
then read a long, seemingly
pre-prepared decision denying
the motion to dismiss. Inner
City Press covered and
answered questions online
about it.
When Murray's lawyer asked for
time to brief a question that
had come up, Judge Woods says
no, that it is "shocking" that
these arguments weren't
ready.
In
the case, Assistant US
Attorneys Jacob Warren and
Maurene Comey have argued that
because the two men are
charged with a crime
punishable by death, there is
no statute of limitation,
citing the Second Circuit's
decision in US v. Payne, 591
F.3d 46 (2d Cir. 2020).
Judge Woods
agreed. Inner City Press will
