NYC Wants Fentanyl Statements Admitted

SDNY COURTHOUSE,
Sept 15 – Bishme Ayers, of
Reading, Pennsylvania, has
sued the NYC Department of
Corrections for how he was
treated in their custody at
Jacobi Hospital.
On August 4, U.S. District
Court for the Southern
District of New York Judge
John G. Koeltl held a
proceeding. Inner City Press
covered it.
Judge
Koeltl ran through a number of
motions in limine, ruling for
example that evidence about
Ayers' misdemeanor convictions
would be excluded.
Now on September
15 NYC's Law Department has
written in, "further to
today's argument regarding the
admissibility of... statements
made by plaintiff for the
purpose of medical treatment."
One might think these would be
privileged. But NYC says the
admission of ingesting
fentanyl is a prior
inconsistent statement.
