SDNY COURTHOUSE,
Sept 26 – Juan Ramos sued El
Valle 3452 Restaurant Inc. in
May 2021 for failure to pay
overtime and minimum wage. By
September he wanted to drop
the case, admitting he
couldn't prove he'd ever
worked
there.
On September 24 U.S. District
Court for the Southern
District of New York Judge
Gregory H. Woods held a
proceeding. Inner City Press
covered it.
Not
for the first time, Judge
Woods told the parties that
their proposed settlement or
notice of dismissal did not
meet the standard requireed by
Cheeks v. Freeport Pancake
House, 796 F.2d 199 (2d
Cir. 2015).
The plaintiff's
lawyer, using the phrase "law
office fail," acknowledged he
didn't know Cheeks.
Judge Woods
was acerbic, and said it will
be up to the parties to
appropriately dismiss - or go
forward with the case.
