Professors Suing To Not Join Union Tee Up
Case for 2d Circuit Maybe Supreme Court

SDNY COURTHOUSE,
March 9 –
Avraham Goldstein and other
City University of New York
professors have filed a
Federal lawsuit saying they
"strongly object to being
exclusively represented by the
Professional Staff
Congress/CUNY."
On March 9, U.S. District
Court for the Southern
District of New York Judge
Paul A. Engelmayer held a
proceeding. Inner City Press
covered it.
Judge
Engelmayer said these are big
issues; he surmised that the
parties were seeking to tee up
the issue for review by the
Second Circuit and perhaps
U.S. Supreme
Court.
To that
end, he told them that after a
motion to dismiss he will then
allow time to amend the
complaint, but to hurry one
way or the other as it would
slow down the rise of the
case.
The
schedule is motion to dismiss
by April 20. If there is an
amendment, then a new briefing
schedule. Discovery is stayed.
