SDNY COURTHOUSE,
June 26 – In one in a series
of website inaccessibility
cases under the ADA, Jose
Quezada sued Bloomberg, L.P.
for hindering him as a
visually impair person from
purchasing its market analysis
newsletter and digital
subscription.
On
June 24, 2022 U.S. District
Court for the Southern
District of New York Judge
Edgardo Ramos held a
proceeding. Inner City Press
covered it.
Bloomberg's
counsel pointed Judge Ramos to
the EDNY decision in Winegard
v. Newsday LCC (556 F. Supp 3d
173 (Aug 16, 2021)) holding
that "the text of the ADA's
definition of 'public
accommodation' clearly refers
to physical places, and does
not include stand-alone
website."
If followed, it
will knock out many cases in
SDNY and other Federal
courts.
Judge Ramos
gave Bloomberg leave to file a
motion to dismiss by July 15.
