New York Times Is Sued for Intersectional Discrimination by Bernadette Dashiell Now Plan

SDNY COURTHOUSE, Nov 2 – The New York Times has been sued for racial discrimination by long time Art Director Bernadette Dashiell, previously of the Newark Star-Ledger. 

 The case, wheeled out to U.S. District Court for the Southern District of New York Judge Paul A. Engelmayer, has been reviewed in the docket by Inner City Press, which covers SDNY daily. 

 Dashiell's complaint cites discrimination in employment on the basis of race, gender and age, "as well as 'intersectional' or 'race plus gender' discrimination."  

 The complaint recounts that Dashiell "was assigned responsibility for the Thursday Styles Section, a part of Features."

And, "Plaintiff's pay has been lower than similarly situated employees who were non-Black, male or younger than Plaintiff, since at least 2006." 

  To that, the New York Times responded "Defendant denies the allegations contained in Paragraph 70 of the Complaint."

On November 2, Judge Engelmayer held his initial pre-trial conference and ruled, "All parties do not consent to conducting all further proceedings before a Magistrate Judge, including motions and trial. 28 U.S.C. § 636(c). This case is to be tried to a jury. Any motion to amend or to join additional parties shall be filed within 30 days from the date of this Order. The Final Pretrial Order date is thirty (30) days following the close of fact and expert discovery (whichever is later), unless a dispositive motion is requested. Counsel for the parties have conferred and their present best estimate of the length of trial is 4 days. Deposition due by 3/23/2023. Fact Discovery due by 3/23/2023. Expert Discovery due by 5/9/2023. Case Management Conference set for 4/26/2023 at 10:00 AM before Judge Paul A. Engelmayer. (Signed by Judge Paul A. Engelmayer on 11/2/2022)"
